Mechelle Vinson alleged that during her four years with the Meritor Savings Bank, her supervisor, Sidney Taylor, repeatedly demanded sexual favors from her and that she had sexual intercourse with him on 40 to 50 separate occasions. She also contended that Taylor fondled her in front of other employees, followed her into the women’s restroom, exposed himself to her, and forcibly raped her on several occasions. Despite these allegations, however, Vinson apparently was well treated by her employer in other respects. She received three promotions during her time with the bank, and it was undisputed that her advancement was based solely on merit. Assuming that Vinson’s allegations are true and that Taylor’s behavior was unwelcome to her, can she recover against the bank for quid pro quo sexual harassment? Can she recover for work environment sexual harassment? Assume that the bank would be liable for Taylor’s behavior.
