Linda Twinkle, a receptionist for the XYZ Corporation, was stationed at the gateway to the image-conscious firm’s plush offices. Linda joined a small religious cult whose members believed that it is unnatural and immoral for people to bathe. Linda followed this practice 100 percent. Soon enough, XYZ employees, potential customers, and other visitors to the firm began to be grossed out by Linda’s appearance and her odor. Eventually, XYZ switched Linda to its janitorial staff. Linda sues under Title VII, alleging discrimination on the basis of her religion. Will XYZ succeed if it argues that it was not discriminating against Linda’s religion, but rather against her appearance and her aroma? Will it succeed if it argues that Linda’s small cult does not count as a “religion” under Title VII? What else can the firm argue? Will this argument work?
