Aubrey Reeves purchased a computer system for his business from Radio Shack Computer Center. Radio Shack is the local retailer for products sold by Tandy, its parent company. During negotiations, it became clear that Reeves needed software that Radio Shack could not provide. A Radio Shack salesperson referred Reeves to a software source book, let Reeves know he could choose compatible software from the source book, and informed him that Tandy did not support or service software from the source book. A disclaimer to this effect was in the source book. Reeves eventually purchased computers from Tandy, some software from Tandy, and more specialized software from a company called Lizcon. The Lizcon software did not meet Reeves’s needs. Reeves subsequently sent a letter to Tandy, asking for rescission of the contract and damages. Could Reeves rescind?
