Review the material/files on the three cases (Kelo, Atlantic Yards, TransCanada Pipeline) I’ve attached to this posting. Then do some additional Internet research. Write a two to three-page personal opinion paper on their outcomes.
Part A. You are a member of the US Supreme Court hearing the Kelo vs. New London case in 2005… so you’ve GOT to make a decision … no equivocation … no BS’ing … no fluff. Do you agree with the majority opinion … or the minority opinion ? Defend your opinion ! LOGICALLY lay out your reasoning in a 300 word (minimum … no maximum) opinion abstract. Assume that your abstract will be read tonight on FOX and MSNBC, so you’re going to be vilified either way. NO (repeat “NO”) background summary … we all already know the background.
Part B. Finally (and in addition to the 300 words above) it is now 6 -7 years after you issued your opinion per Part A. above. Two new eminent domain cases have now captured the public attention. One is the recently litigated Atlantic Yard/ Ratner controversy in Brooklyn, New York, and the other is an emerging legal battle near Paris, Texas involving the TransCanada pipeline company and a family ranch managed by M s. Julia Crawford. After you’ve researched each of these two controversies, I want you to devote another 300 (minimum) words in SUCCINCTLY explaining whether either or both of these modified or reinforced the conclusions that you came to seven years ago. You don’t have to give each of these recent controversies the same amount of text, but you DO have to devote sufficient attention such that it is obvious that you researched both, took them both into consideration, and commented confidently on both. Caution … each of the articles, hyperlinks, videos etc. attached above has its own “spin”. Typically, the spin is almost always on the perspective of the (media) perceived “victim”. After all … “wrongs” make the news … not “rights”. There is often difficulty in finding concise unbiased opinion, and the opinions in these popular sources will appear one-sided. Try to disconnect from the “spin”, do additional research into the circumstances (the internet is loaded with commentary), and focus on the legal principles that have come into conflict. In other words, form your OWN opinion ! I will also attach these Instructions in a Word Document .
