A highly paid and very talented African-American NFL running back, Jerome Crawford, had a reputation for being outspoken on what he believed were racial inequities within American society. This resulted in conflicts between Crawford and his teammates and management. During an away game, Crawford was subjected to verbal abuse from fans. Although most of the fans’ statements were not racially based, a few were. The latter included threats, such as “we will kill you,” and a dummy in blackface with Crawford’s number on it. The player reacted by directing an obscene gesture toward the fans. Because of his response, the player was fined $10,000 by the NFL for a lack of professionalism. The player refused to play until the league and individual teams implemented measures to protect African-American and other minority football players from racially motivated abuse by fans. You are general counsel for the team on which Crawford plays. What advice should you give to team management as to how it should respond to Crawford’s refusal to perform?
