Bernardo, a middle school student who has a physical disability, wants to participate in an extracurricular activity. He has been placed in a school across town since there is no special education class in his neighborhood school. He has to ride a bus to and from school, and because his afternoon bus ride is 30 minutes, he is not dropped off at his home until 3:30 P.M. All extracurricular activities at Bernardo’s neighborhood school begin at 3:15 P.M. The school has refused to change the bus schedule. Bernardo is being excluded from a program because of his disability. Do you think this is a violation of IDEA or of Section 504?
